Licensing & AI disclosure
This page is guidance, not legal advice. Store policies and the law around AI-generated content are changing. Check the current rules of each platform before you publish.
Who owns what you generate
Subject to the Terms of service, the assets you generate with Kitsmith are yours to use, including in commercial games, on every plan including Free. You can modify them, ship them in your game, and sell them as part of it. Kitsmith does not claim ownership of your outputs.
Two caveats:
- In some jurisdictions, purely AI-generated material may not be protected by copyright. Your rights are strongest where you have added meaningful human work: selection, arrangement, editing and integration.
- You are responsible for your prompts and uploaded references. Do not upload images you do not have the right to use, and do not prompt for trademarked characters or logos.
Model provenance
The pipeline is built from models and assets selected because their licenses permit commercial use of the outputs:

Kit planning uses a large language model on Google Vertex AI; it produces text (asset lists and prompts), not assets. Each kit package includes a LICENSE file with the exact notices that apply to its contents. If you need provenance details for a publisher or platform review, that file is the reference.
AI disclosure
Every package includes AI_DISCLOSURE.txt describing what was generated and how. Most stores now ask about AI content. Here is where, at the time of writing:
- Steam: the Content Survey in Steamworks has an AI Generated Content Disclosure section. It distinguishes pre-generated content (made during development, which is what Kitsmith assets are) from live-generated content created while the game runs. Your description appears on the store page.
- Fab (Unreal / Epic marketplace): if you resell Kitsmith assets as an asset pack, Fab requires listings that contain AI-generated content to be tagged as such.
- itch.io: asks creators to mark projects that use AI-generated content, with separate options for graphics, sound and text, and asset packs with AI content should be tagged accordingly.
- Console platforms and publishers have their own questionnaires. The disclosure file gives you the facts to answer them.

Reselling assets
You may sell games that contain Kitsmith assets. Reselling the assets themselves as an asset pack is also permitted under the current draft terms, but you must follow the target store’s AI content rules, and you should not present the pack as hand-made.
