Terms of service

Draft — not yet reviewed by counsel. These terms are a working draft published for transparency during the beta. They will be replaced by a reviewed version, and we will notify registered users when that happens.

1. The service

Kitsmith (“we”, “us”) provides a web application for generating game assets such as 3D models, textures, characters and related files (“the service”). By creating an account or using the service you agree to these terms. If you use Kitsmith on behalf of a company, you confirm you are authorised to accept these terms for it.

2. Accounts

  • You must provide a valid email address and keep your password secure.
  • You are responsible for activity under your account.
  • You must be at least 16 years old, or the age of digital consent where you live if higher.
  • One free sign-up credit grant per person. Creating multiple accounts to collect extra credits is not allowed.

3. Your content and outputs

Inputs. You keep all rights to the prompts, descriptions and reference images you submit (“inputs”). You grant us a limited licence to store and process your inputs solely to operate the service for you, including conditioning generations and training a style model for your project.

Outputs. As between you and us, you own the assets generated for you (“outputs”) to the extent permitted by applicable law, and you may use them for any lawful purpose, including commercial games and asset packs. We do not claim ownership of your outputs. Copyright protection for AI-generated material varies by jurisdiction, and we make no promise that outputs are protectable.

Similar outputs. Generative systems can produce similar results for different users. Your ownership does not extend to outputs independently generated for others.

Your responsibility. You are responsible for your inputs and for how you use outputs. You must have the rights to any reference images you upload. Do not upload or prompt for material that infringes someone else’s copyright, trademark, likeness or other rights, and do not attempt to recreate specific protected characters, logos or products.

4. Acceptable use

You agree not to use the service to:

  • Generate content that is illegal, sexually explicit involving minors, or intended to harass or defame real people.
  • Upload content you do not have the right to use, or that contains malware.
  • Interfere with the service, probe or bypass its security or limits, or access internal endpoints.
  • Scrape the service or use automated means to create accounts or queue jobs, except through an official API.
  • Resell access to the service itself.

We may suspend or terminate accounts that break these rules, and may remove content that violates them.

5. Credits and payment

  • Jobs are paid for with credits, charged when a job is queued. Current costs are listed in the credits documentation.
  • Jobs that fail permanently are refunded automatically in credits.
  • Credits are otherwise non-refundable, have no cash value and cannot be transferred.
  • Rejecting a completed asset during review does not entitle you to a refund.
  • We may change credit costs and plans with notice. Changes do not affect jobs already queued.
  • Paid plans, when available, will be governed by the pricing shown at checkout.

6. AI disclosure

Outputs are produced with machine learning models. You are responsible for complying with the AI content disclosure rules of any platform where you publish or sell work containing outputs. Each kit package includes an AI disclosure file to help you do this.

7. Beta service, “as is”

The service is in beta. It is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Features may change or be removed. Keep your own copies of anything you need.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim, or USD 50 if you paid nothing.

9. Termination

You can stop using the service and ask us to delete your account at any time. We may suspend or end your access if you breach these terms or if we discontinue the service. On termination, unused credits lapse. Your rights in outputs you have already downloaded continue.

10. Privacy

How we handle personal data is described in the Privacy policy.

11. Changes

We may update these terms. We will post the new version here and, for material changes, notify you by email. Continuing to use the service after changes take effect means you accept them.
